EXPERIENCE

    Case Study

  • Grande North Window Replacements

In 2021, a window supplier sued for coverage under an OCIP policy to recover the $2.5 million it paid to replace more than 2,000 windows at a condo tower in San Diego, California. The underlying window claims concerned dripping sealant, which created visual obstructions. It was undisputed that the sealant only damaged the windows and that faulty installation did not cause the sealant to drip. The court granted summary judgment in favor of the insurer, finding no coverage under the OCIP policy.

  • Obtained a defense verdict on a reformation claim, which resulted in the dismissal of the insured’s remaining breach of contract and bad faith claims concerning coverage for a catastrophic automobile accident reported under a commercial auto policy.

  • Favorably resolved a complex, high-visibility, professional liability claim arising from geotechnical advice provided as part of a large freeway expansion project.

  • Provided coverage advice under Lawyers Professional Liability Policies concerning claims alleging Ponzi schemes involving gold, real estate, and cryptocurrency investments.

  • Provided coverage advice under Architects & Engineers Professional Liability Policies concerning related-claims issues, covered and uncovered damages and claims expenses (e.g., fee disgorgement), additional named insureds, and indemnity and contractual liability issues for large infrastructure projects and multi-use developments.

  • Advised client regarding coverage under a medical malpractice policy issued to physicians and their fertility clinic with respect to a nine-digit exposure claim arising from a failed cryopreservation tank.

  • Provided clients with in-depth risk analyses and exposure evaluations taking into account relevant coverage concerns, projected defense expenses, and possible liability based on defense counsel and expert advice and analysis.

  • Collaborated with insurers, insureds, defense counsel, and experts to manage large-exposure, professional liability claims (and related coverage issues) and recommended accurate reserves to effectuate cost-effective resolutions of complex claims.

  • Successfully represented domestic and international insurers at mediations arising from professional liability and general liability claims (and their constituent coverage issues) concerning alleged design errors and omissions, construction defects, attorney malpractice, construction management issues, and real estate development issues.
