Privacy Claims, Coverage Disputes, and the Illusion of Protection

On March 12, Jonathan T. Viner will serve as a speaker at DRI’s 2026 Insurance Coverage & Claims Institute (ICCI) in Chicago, a program that brings together insurance industry professionals and coverage counsel to address cutting-edge issues facing the market. This year’s ICCI features sessions on topics such as business interruption coverage, towers of coverage, navigating bad faith exposure, and other emerging challenges impacting insurers nationwide.
 
Jonathan’s breakout session, Privacy Claims, Coverage Disputes, and the Illusion of Protection, will examine the evolving landscape of privacy-related litigation, including claims arising from data breaches, unauthorized use of personal information, and alleged violations of name, image, and likeness rights. The program will explore how these claims are treated under various policy forms, including Coverage B, and will address how mediation strategies and certain policy exclusions may, in some jurisdictions, create arguments that coverage is illusory.
