Navigating Disclosures and Conflicts in Insurance Arbitrations and Mediations

Ethical and Practical Considerations to Ensure the Neutrality of Your Neutral and Enforceability of Your Award or Settlement

Location: American College of Coverage Counsel's 2026 Annual Meeting
On May 8, Ellen Van Meir will serve as a panelist at the American College of Coverage Counsel’s (ACCC) 2026 Annual Meeting, participating in the session Navigating Disclosures and Conflicts in Insurance Arbitrations and Mediations: Ethical and Practical Considerations to Ensure the Neutrality of Your Neutral and Enforceability of Your Award or Settlement.

The program will examine the ethical, practical, and legal considerations surrounding disclosures and conflicts in insurance-related arbitrations and mediations. Whether serving as counsel or as a neutral, practitioners must carefully navigate potential conflicts—particularly in the context of repeat appointments, hybrid proceedings such as med-arb, and cross-border disputes—to avoid disruptions that can jeopardize the integrity of the proceeding or the enforceability of a resulting award or settlement.

Panelists will discuss real-world scenarios in which disclosure or conflict issues have disrupted proceedings, offering practical guidance on how to identify and address these risks before they become obstacles. The session will provide insight into best practices for maintaining neutrality and ensuring that arbitration awards and mediated settlements withstand scrutiny.
