On February 17, Tamiko A. Dunham will serve as a speaker on a BARBRI CLE webinar titled Insurance, Accidents, and Policyholder Mental Incapacity: Proving Occurrence; Defeating Intentional Loss Exclusion.
The program will examine when an insured’s mental incapacity may cause an otherwise intentional act to be construed as an accident for purposes of establishing an “occurrence,” as well as when mental incapacity may defeat application of an intentional loss exclusion. The discussion will also address how courts evaluate occurrence and accident where an insured’s conduct results in unintended damage, along with varying jurisdictional approaches to intentional conduct, diminished capacity, and legal responsibility.
