Coming Soon to an Arbitration Near You: Trends in U.S. Mass Tort Litigation and the Insurance Disputes That Are Sure to Follow

Location: London Arbitration Week 2025
On December 2, 2025, Monica T. Sullivan will serve as a panelist at London Arbitration Week 2025. The panel, “Coming Soon to an Arbitration Near You: Trends in U.S. Mass Tort Litigation and the Insurance Disputes That Are Sure to Follow,” will explore the expanding intersection between U.S. mass tort claims and international insurance arbitration.

The discussion will address how the United States, long the global epicenter of mass tort litigation, continues to generate new waves of claims spanning multiple industries, from PFAS, opioids, talc, pesticides, and hair relaxers to medical devices, sexual abuse, and catastrophic wildfires. These large-scale claims often trigger complex coverage disputes involving billions of dollars, many of which are now being resolved through ad hoc, English-seated arbitrations.

Panelists will examine emerging U.S. mass tort trends, evolving theories of liability, defense strategies, and the key issues insurers and policyholders should anticipate as these disputes migrate into arbitral fora.
