The U.S. Court of Appeals for the Second Circuit is preparing to hear an insurance coverage appeal stemming from litigation involving claims related to ghost guns, part of a broader trend of suits examining the application of general liability coverage to public nuisance claims.
The case addresses key questions about whether policies cover claims tied to intentional business conduct and could help clarify how courts are likely to apply the “occurrence” requirement and assess the duty to defend in novel tort contexts.

“The tort of public nuisance historically was used for different types of cases,” Amy said, noting that the ruling could add more authority in an underdeveloped area of law.
