A Game of Chance: Insurance and the Concept of Fortuity

On September 18, Richard H. Nicolaides, Jr. will present “A Game of Chance: Insurance and the Concept of Fortuity” at the Wyoming State Bar’s 2025 Annual Meeting & Judicial Conference.

Commercial insurance products are designed to cover the wide range of risks to which businesses operating in diverse industries across the country and around the world are exposed. While the scope of coverage under insurance products may differ, all insurance is predicated on the concept of “fortuity,” the idea that insurance covers risks resulting from chance events.

From manufacturing defects to terrorist funding, as well as emerging risks such as climate change and opioids, the presentation will address fortuity in the context of the standard Commercial General Liability Policy, with a particular focus on the “occurrence” requirement and the “expected or intended injury” exclusion.
